Terms of Service

These Terms govern your use of Intelligent Notes (https://intelligent-notes.com) and its three application surfaces:

• free.html – Free Local Notebook
• app.html – Author Edition (requires Author or Scientific subscription)
• scientific.html – Scientific Edition (requires Scientific subscription only)

By using any surface, you agree to these Terms.

1. Account & Access Rules

• free.html: No login required. Anyone can use it.
• app.html: Must log in via Google/GitHub and have an active Author or Scientific subscription.
• scientific.html: Must log in and have an active Scientific subscription only.

Free account holders (logged in but no paid subscription) can access free.html and a dashboard/settings page. Admin (leviathan.html) is restricted via Cloudflare Access.

2. Subscription Tiers & Entitlements

• Author subscriber → can use app.html (cloud sync, D1 database, hosted AI/Gemini, Author features).
• Scientific subscriber → can use both app.html and scientific.html. Scientific includes all Author features plus: larger workspace, multiple notebooks, cross‑notebook Event Horizon, extended AI worker, LaTeX/equation tools, research workbench.

Important: Scientific subscription automatically grants access to Author features. No need to buy both.

3. Payments & Billing (Stripe)

• All fees are in GBP (£) — Stripe converts to your local currency at checkout exclusive of VAT (if applicable).
• By subscribing, you authorise Stripe to charge your payment method automatically at the start of each billing period.
• Cancellation: Cancel any time from your account settings. If you cancel within 30 days of any payment, you receive a full refund of that payment — including any transaction fees, which we absorb entirely. No questions, no penalties, no deductions. After 30 days, cancellation takes effect at the end of the current billing period with no further charge.
• We may change prices with 30 days' email notice. Continued use after the change constitutes acceptance.

4. Free Tier Limitations

free.html is a local‑first notebook: all notes stored in browser local storage. No cloud sync, no D1 database, no AI features. Upgrade prompts may appear but never lock your existing notes. We may change free tier features with reasonable notice.

5. User Content & Conduct

You retain ownership of your notes. By using cloud sync (Author/Scientific), you grant us a licence to host, store, and backup that content solely to provide the Service.

Prohibited: Uploading illegal content, attempting to bypass access controls, reverse engineering, or scraping the Service. Violation may result in immediate suspension or termination.

6. Intellectual Property

The Service's code, design, logos, and text are owned by Intelligent Notes. The Event Horizon cross‑notebook feature is a proprietary method – you may not replicate it.

7. Third‑Party Services

Your use of Google, GitHub, Stripe, Cloudflare D1, and Gemini API is subject to their respective terms. We are not responsible for their downtime or data breaches.

8. Termination

You may delete your account at any time from your dashboard. We may terminate or suspend your account if you breach these Terms, abuse the Service, or fail to pay. Upon termination, we will delete your cloud data within 30 days (except financial records required by law).

9. Disclaimers & Limitation of Liability

• Service "as is" – we do not guarantee uninterrupted, error‑free, or secure operation.
• No liability for data loss – you are responsible for backing up important notes.
• Limitation of liability – to the maximum extent permitted by UK law, our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim, or £100 if you paid nothing.
• Nothing excludes liability for death, personal injury, or fraud.

10. Indemnification

You agree to indemnify us against any claims arising from your misuse of the Service or violation of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales. Any dispute shall be resolved exclusively in the courts of London, UK.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified by email or a prominent notice on the Service. Continued use after the effective date means you accept the changes.
